Terms and Conditions

1. Service Description

Ataw provides a trip planning service, preparing a detailed itinerary based on the Client’s preferences.
The process is:

  1. Pay an initial deposit of 10% via the website and complete a contact form with trip details.

  2. Ataw will arrange an initial call via email or WhatsApp to discuss your preferences and budget.

  3. Ataw prepares itinerary options for your review.

  4. Upon confirmation, the remaining balance must be paid in full before delivery of the complete itinerary.

Revisions:

  • The Basic Itinerary Package includes up to 2 revisions, and the Extended Itinerary Package includes up to 3 revisions.

  • Revisions refer to minor modifications to the itinerary based on client feedback. Reasonable revisions include adjustments such as changes to dates, times, or activities without altering the overall structure of the itinerary.

  • Any additional revisions beyond the included number will incur a cost of €50 per revision, unless otherwise agreed in writing with Ataw.

  • Major changes, defined as modifications that substantially alter the itinerary (including but not limited to changes of destination, trip length, or core structure), are not considered revisions and will require a new service agreement and payment.

  • These conditions apply both before and after delivery of the final itinerary.

    Note: Bookings are not included unless requested and paid for as an additional service.

2. Booking Process

2.1 Contact & Call
Upon receiving your deposit and completed contact form, Ataw will arrange a call to better understand your trip goals.

2.2 Full Payment
The remaining balance must be paid before delivery of the itinerary.

3. Contract & Agreement

By using Ataw’s services, you accept these Terms & Conditions in full. This Agreement is the entire contract between you and Ataw. It can only be amended in writing by Ataw.

4. Responsibilities

Ataw’s Responsibilities:

  • Create a detailed itinerary based on your requests.

  • Arrange bookings with service providers if requested and paid for.

Client’s Responsibilities:

  • Provide accurate and complete information.

  • Pay the deposit and the remaining balance as agreed.

  • Disclose any special requirements at booking.

  • Request revisions within the limits included in the chosen package. Additional revisions beyond these limits will be charged at €50 each, unless otherwise agreed with Ataw.

  • Ensure passports, visas, permits, vaccinations, and compliance with laws.

  • Carry personal travel insurance if requesting Ataw to provide a guide.

  • Ensure luggage complies with service providers’ limits.

5. Liability

Ataw is not responsible for third-party service failures, changes, or cancellations. Liability is limited to what is permitted under Portuguese law and excludes indirect losses. Nothing in these Terms excludes liability for death or personal injury caused by Ataw’s gross negligence or wilful misconduct.

6. Special Requirements

Clients must disclose requirements at booking. Ataw will make reasonable efforts to accommodate them, but cannot guarantee fulfillment.

7. Acceptance of Risk

Where Ataw provides a guide, the Client acknowledges that adventure travel involves risks. The Client assumes all such risks and releases Ataw from liability for injury, damage, or loss arising from the guided trip. This does not apply to itinerary planning services without a guide.

8. GDPR Compliance

Ataw complies with GDPR. Your personal data is:

  • Collected via the contact form for trip planning.

  • Stored securely.

  • Used solely for delivering the service.

  • Shared only with required service providers.

9. Cancellation Policy

9.1 By the Client:

  • Cancellation before itinerary delivery: deposit (10%) is non-refundable.

  • Cancellation after itinerary delivery: the full service fee is non-refundable.

9.2 By Ataw:
Ataw may cancel before delivery if:

  • Minimum requirements are not met.

  • Circumstances beyond control prevent delivery.

9.3 Force Majeure:
Neither party is liable for events beyond reasonable control (e.g. natural disasters, pandemics, strikes, governmental actions).

10. Intellectual Property

Itineraries, documents, and content created by Ataw are protected intellectual property.

  • Clients may use itineraries only for personal purposes.

  • Reproduction, sharing, or commercial use without written consent is prohibited and may result in legal action.

11. No Guarantee of Outcome

Ataw uses reasonable care but does not guarantee the availability of services, prices, or specific experiences exactly as described.

12. Third-Party Services

Third-party services are subject to their own terms. Ataw is not responsible for failures of third-party providers.

13. Client Conduct

Clients must comply with laws and behave respectfully. Ataw may terminate services without refund for misconduct.

14. Amendments

Ataw may amend these Terms & Conditions at any time. Changes will be communicated to clients before service delivery.

15. Severability

If part of these Terms is unenforceable, the rest remains valid.

16. Governing Law

Portuguese law governs these Terms. Disputes fall under the exclusive jurisdiction of Portuguese courts.

17. Entire Agreement

These Terms & Conditions and the service proposal form the entire agreement between the Client and Ataw.

18. Dispute Resolution

Disputes shall first be attempted to be resolved amicably. If unresolved, mediation under Portuguese law will be pursued. Failing mediation, disputes will be submitted to the exclusive jurisdiction of Portuguese courts.
