Giveaway Terms & Conditions

The following Terms and Conditions will define the giveaway on Instagram and TikTok by ATAW (Travessióasis, LDA).

ATAW is promoting this giveaway on both its Instagram and TikTok channels. This is one campaign, where only one participant of either Instagram or TikTok is eligible to win.

1.    Eligibility: The giveaway contest is open to participants who meet the following criteria: 

·       Are 18 years of age or older

·       Are not employees of ATAW or their affiliates, nor members of their immediate families or households

2.    Entry: To enter, participants must follow the instructions outlined in the contest post on Instagram and TikTok. Entry requirements include following ATAW’s instagram or TikTok, tagging minimum one friend, and planting a minimum of 4€ worth of trees on ATAW’s Tree-Nation page with the name of the participant identifiable with their Instagram or TikTok handle. Entries complete, accurate, but submitted after the deadline will be disqualified.

3.    Duration: The giveaway contest starts on 12.12.2023 and ends on 31.12.2023 at 11.59pm (GMT). Only entries submitted before the deadline will be considered.

4.    Prize: The winner will receive a spot for themselves and a friend of their choice for the Peru Group Trip from the 31th August to 14th September 2024. The winner and their friend must be able to attend the trip on these specific dates. No alternatives will be offered. ATAW will cover the trip costs as stated on the included section of the website (https://www.atawtravels.com/adventurous-peru) and a roundtrip flight for them and their friend to and from Lima. Anything else that falls within the non-included section on the website should be covered by the winner and their friend. The prize, as defined in the terms, is non-transferable, and there will be no cash alternatives to it. In case either the winner or their friend cannot take part in the trip, the other person can still attend. There won’t be any compensation alternatives for the non-attending person. ATAW reserves the right to substitute the prize with a product or service of equal value.

5.    Winner Selection: The winner will be selected randomly from all eligible entries by the deadline. The winner will be notified by Instagram or TikTok direct message within three days after the deadline. If the winner does not respond within 48 hours, another winner will be selected.

6.    Publicity: By participating in the giveaway contest, the winner agrees to allow ATAW to use their name, photograph, and likeness for promotional and advertising purposes without compensation.

7.    Liability: ATAW is not responsible for any injury, loss, or damage to participants, or their property related to their participation in the giveaway contest. Participants agree to release and hold harmless ATAW and their affiliates from any liability, injury, loss, or damage resulting from participation in the giveaway contest or acceptance, use, or misuse of the prize.

8.    Affiliation: Instagram or TikTok are not in any way affiliated or involved in the competition.

9.    Governing Law: The giveaway contest and these terms and conditions are governed by and construed per the laws of Portugal.

10. Dispute Resolution: Any dispute arising from or related to the giveaway contest, or these terms and conditions will be resolved through binding arbitration per the rules of Portugal. The arbitration will occur in Ovar, Portugal, and the arbitrator’s decision will be final and binding.

11. Modification: ATAW reserves the right to modify, suspend, or terminate the giveaway contest without notice. ATAW also reserves the right to modify these terms and conditions without notice.

12. If the modification or cancellation is due to force majeure (i.e. circumstances such as political instability, war or threat of war, riots, civil conflicts, closure of airports or ports, terrorist activities, disasters of any kind, fire, epidemic or of health risk, abnormal weather conditions or other similar events beyond the control of Ataw (Travessioásis – Lda) and provided that this situation occurs by national or international directive through state or governmental entities, ATAW reserves the right to change the prize conditions without notice.

By participating in the giveaway contest, participants agree to be governed by these terms and conditions, as defined by ATAW.
